Due process provision in the ‘big beautiful bill’

A provision in the national budget bill, also known as the “big beautiful bill,” could cause big changes to due process.

Due process provides protections for individuals from arbitrary actions from the government as a constitutional right. This includes deportation, as deportation without being able to appear before a judge is a violation of due process.

This is coming about as the Trump Administration is facing several rulings for not allowing deported individuals their due process. This due process provision would make any ruling regarding the hindering of due process against President Donald Trump unenforceable.

Robert McWhirter, Constitutional Law Expert, joined “Arizona Horizon” to provide insight on this provision on due process.

McWhirter explained what the due process is and the importance of it.

“Well due process is the process that you are due. It used to be called the law of the land in magna carta. And what it says is that everybody has a right to expect a process like oh, if you’re charged with a crime you’re advised of the crime, you have a right to a lawyer, all these rights that happen. And everybody has a right to that, including people who are in the country without documentation,” McWhirter said.

McWhirter shared that this provision has been written with the Trump administration in mind.

“It’s kind of a slight at hand, they’re not saying that we’re going to get rid of the power of a judge to do nationwide injunctions. What we’re doing is changing a little bit rule 65(c) that says that you have to post a bond before you get that injunction for the value of the loss of whatever the injunction causes if you end up losing your ask for the injunction. So in an essence wipes it out because who can afford a billion dollar bond on a trade issue,” McWhirter said.
