Arizona Proposition 314: Immigration law and public safety debate

Arizona Proposition 314, also known as HCR 2060, would make it a state crime for noncitizens to enter the state directly from a foreign nation other than the official ports of entry, and allow for state and local police to arrest noncitizens who cross the border unlawfully.

The debate over Arizona Proposition 314 has garnered attention, featuring key voices on both sides. Senator John Kavanagh (R), District 23, supports the measure. Conversely, Kimber Lanning, Founder and CEO of Local First Arizona, presented concerns and arguments against the proposition. Both leaders appeared on “Arizona Horizon” to discuss their perspectives and the implications of this proposed amendment.

Under this measure, a person may not be arrested without probable cause. It would allow for state judges to order deportations. It would require the use of the E-Verify program in order to determine the immigration status of individuals before the enrollment in a financial aid or public welfare program.

This would make it a Class 6 felony for individuals who submit false information or documents to an employer to evade detection of employment eligibility under the E-verify program or to apply for public benefits. This measure would make the sale of fentanyl a Class 2 felony if the person knowingly sells fentanyl and it results in the death of another person.
