Immigration proposition passes

Arizona Proposition 314, which dealt with immigration, passed by a large margin in our state. This ballot measure would allow police to arrest immigrants who don’t cross the border at a legal port of entry and would make it a state crime for people living in the U.S. illegally to apply for public benefits. It also would create a crime of selling fentanyl that causes someone’s death.

Delia Salvatierra of Attorney of Salvatierra Law Group joined “Arizona Horizon” to discuss the impact of Proposition 314 passing.

In a word, Salvatierra says that the passing of Proposition 314 calls for “mayhem.”

“It creates an avenue for the legislature to create new avenues of criminal conduct that belong with the federal authorities,” Salvatierra said.

As of November 13, 2024, the ballot passed in Arizona with 62.6% voting yes to turn the measure into law.

“The statute may say what it wants to accomplish but it doesn’t say how its going to accomplish it, and it’s the ‘how’ that got Arizona in deep waters in Arizona vs United States in SB1070 and that’s why it was struck down because it simply did not have the authority to do what it said it would do,” Salvatierra said.
